Oracle v. Google: May 2021 Update

Earlier this 12 months, the US Supreme Court determined this case in favor of Google’s honest use argument and rejecting the Federal Circuit’s reverse conclusion. On remand, the Federal Circuit has now issued a brief order within the case sending it again all the way down to the District Court.

In its order, the Federal Circuit recalled its mandate within the case “solely with respect to fair use.”  That implies that its judgment favoring Oracle on the query of copyrightability nonetheless stands.  Finally, the “district court’s final judgment in favor of Google is affirmed.” Neither social gathering had filed extra briefs within the appeal following the Supreme Court’s determination.
