Protecting Real Innovations by Improving Patent Quality


Intellectual Property laws and oversight within the Senate goes by the Intellectual Property Subcommittee of the Judiciary Committee.  On June 22, the Subcommittee heard testament on the subject of ongoing issues with “low quality patents.”

  1. It is hard to determine the standing of a patent and identification of the patent homeowners.
  2. Discussion of the Theranos-Holmes drawback (patents issued and asserted even after prison fraud indictment) — see Contreras Testimony.  But typically, the issue isn’t seen as fraud however low-quality patents.
  3. Contreras — there needs to be extra concentrate on discount to follow on the examination stage.
